Probate in California is a lengthy and tedious legal process. An executor will need to hire a California probate attorney to help administer and oversee the process. Our law firm is dedicated to making the probate process as painless as possible.  However, probate of the decedents estate can take anywhere from 12 months to 2 years if not longer. Probate administrations tend to be a very complicated process.

When do you need to call us?

When a person dies with our without a will, and has assets valued at greater more than $150,000 probate is likely to be necessary.  There are exceptions for assets passing by joint tenancy, beneficiary designations, or through a revocable trust. 

What to expect?

Probate is a formal legal process involving many steps. Our team of legal professionals will guide you through each step and make sure you are comfortable every step of the way:

1.    We will need to go through a process to prove up the Will and or identify the beneficiaries through intestate succession.

2.   A person will need to be appointed to represent the estate, i.e. executor or administrator.

3.   An inventory of the estate assets will need to be completed.

4.   Creditors will need to be paid.

5.   Tax returns will need to be filed for the decedent’s estate.

6.     When the estate is ready to be settled an accounting will need to be filed letting the court and the beneficiaries know what monies were received by the estate, expenses paid, and what remains to be distributed.

7.     After the court has approved the accounting the estate is ready to be distributed, and final papers are filed to close the administration.
